İsmail Rüştü Cirit, the First President of the Court of Cassation, addressed to the exporters in “the Symposium of Trademark Law”:
Intellectual property rights and personal works should be protected for value-added exportation
Istanbul Textile and Apparel Exporter Associations informed the representatives of the textile and apparel sector about branding, intellectual property rights, patents and imitations in the “Symposium of Trademark Law” organized with the support of Turkish Exporters' Assembly (TIM).
İsmail Rüştü Cirit, the First President of the Court of Cassation, participated in the symposium, and he stated: “Turkey has an important mission such as increasing the revenue per kg in the exportation and creating trademarks. Therefore, we should give importance to the intellectual property rights and personal works”. He also underlined that the companies should register their products and that they should legally protect them.
Ömer Burhanoğlu, Member of the Board of Directors of TIM, took the floor in the symposium, and he stated that it was pleasing to see that there were approximately 96 000 applications of brands in 2015. On the other hand, İsmail Gülle, the Chairman of Istanbul Textile and Apparel Exporter Associations, remarked that they strived to eliminate the deficiencies in legal issues.
Istanbul Textile and Apparel Exporter Associations, briefed the representatives of the textile and apparel sector in the “Symposium of Trademark Law” regarding the protection and implementation of intellectual property rights in international competition. İsmail Rüştü Cirit, the First President of the Court of Cassation, was the guest of honor in the symposium, and he stated that Turkey was among the important manufacturers in textile and apparel. He also said: “Turkey has an important mission such as increasing the revenue per kg in the exportation and creating trademarks. Therefore, we should give importance to the intellectual property rights and personal works”. He also emphasized the need for protecting them legally.
The symposium organized with the support of Turkish Exporters' Assembly (TIM) was held with the participation of İsmail Gülle, the Chairman of Istanbul Textile and Apparel Exporter Associations, Ömer Burhanoğlu, the Member of the Board of Directors of TIM, academicians and the representatives of the sector. During the activities, it was emphasized that important steps should be taken in branding, intellectual property rights, patents and transparency.
Law is significant for the investment of foreign capital
İsmail Rüştü Cirit, the First President of the Court of Cassation, took the floor in the symposium, and he mentioned that Turkey had significant targets, and he drew the attention to the importance of the foreign investments. Cirit remarked that foreign capitals investigated the legal structure for investment in the first place. He also said: “therefore, the protection of the brands, intellectual property rights, transparency and legal structure are quite important”. He continued as follows:
“Turkey has recently made certain amendments in numerous basic laws which are suitable for the realities of the society. Are these amendments sufficient? So, we are here for this reason today. Necessary infrastructure should be prepared and the developments should be monitored for the resolution of legal issues. The subjects such as consolidation, business and family law are quite important. Turkey ranks among the top countries in textile and apparel while it ranks 9th in electronics. We need to be prepared already in order to reduce the workload of these sectors in terms of legal issues. We should take the necessary actions by working in cooperation and with the active participation of the representatives of NGOs”.
Cirit also touched upon the necessity for raising qualified and insightful legal experts regarding the above-mentioned issue with the scope of the law. He also stated: “At this point, the problems cannot be solved through classical laws without taking the intellectual property rights into consideration. We carried out significant works such as consolidation, as well. However, since these works do not seem to be appealing, we give importance to the consolidation, mediators and Istanbul Consolidation Center recently opened in Istanbul. We should make the objective of producing solutions to the problems through arbitrator system appealing”.
96 000 brand applications are made in 2015, which is a record level
Ömer Burhanoğlu, the Member of the Board of Directors of TIM, participated in the seminar. He stated that the commercialization of the intellectual property rights such as patent, utility model and brands would add an economic value to the companies, and he reminded the vision of Turkey for 2023. Burhanoğlu remarked that 5302 applications were made to Turkish Patent Institute for patents and that 95 962 applications were made for brands, which was a record level; he said that these figures were pleasing developments. He also stated: “Starting from this point, R&D and intellectual and industrial property rights should be correlated in our companies. On the other hand, the improvement of the knowledge and the skills of R&D officers about the intellectual property rights will make Turkey become one of the top countries in the global competition”.
Legal deficiencies should be eliminated
İsmail Gülle, the Chairman of ITHIB, touched upon the importance of the symposium and the significance of the justice, and he reminded that the justice should ensure the welfare and the peace. “The justice should have such qualifications that people can feel the peace in their hearts. The relationship between the employer and the employee constitutes the first phase in this process. Unfortunately, 99% of the legal cases are concluded against the employer. It's a duty for all of us to lead this ship successfully. We are the companies which struggle against the giant powers such as the USA and China. We are carrying out a quite difficult work, and we are waiting for the pray “May God help you”. The rights of our people are of utmost importance for us, and we never support the wrong side. We are in pursuit of the truth. We are here to make self-criticism and to see our own deficiencies. We want to clarify the legal issues and to eliminate our deficiencies”.
